General provisions
The e-commerce website of Lana Lauwers Ceramics, offers its customers the opportunity to purchase the products from its webshop online.

These General Terms and Conditions ("Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via Lana Lauwers Ceramics' online shop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions.

Price
All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Offer
Despite the fact that the online catalogue is compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Lana Lauwers Ceramics. Lana Lauwers Ceramics is only bound by an obligation of means as to the correctness and completeness of the information offered. Under no circumstances shall Lana Lauwers Ceramics be liable in case of manifest material errors, misprints or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact us in advance.

The offer is always valid while stocks last and may be amended or withdrawn at any time. Lana Lauwers Ceramics cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.


Online purchases
The Customer can click on items to place them in a shopping basket. When viewing the shopping basket, the price (including VAT) of the products is listed. Possible shipping costs are displayed separately (including VAT). Shipping costs may vary depending on the product selected, the country of dispatch and whether the delivery is to a home address.

Payment is via bancontact.

In addition to using the webshop, there is also the possibility of placing an order by contacting us. In this case, a quotation will always be drawn up clearly stating the goods to be delivered, the quantity, colour and delivery method. By approving the quotation, the customer agrees to these general terms and conditions.

Lana Lauwers Ceramics is entitled to refuse an order following a serious shortcoming by the customer in relation to orders involving the customer.

Delivery and execution of the agreement

Once payment has been received, the product will be sent via bpost (or other courier services for international purchases) within 5 working days unless otherwise stated on the website. Lana Lauwers Ceramics cannot be held liable for any delays in delivery. Delivery costs are included and shown separately when purchasing a product via the webshop. If a separate order is placed, possible delivery costs are clearly stated.

Items ordered via this webshop are delivered in Belgium. For orders abroad, please contact us.

Delivery is made by bpost for Belgian orders.

Unless expressly agreed otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order via the webshop.Any visible damage and/or qualitative deficiency of an item or other failure in delivery must be reported by the Customer to Lana Lauwers Ceramics without delay.

The risk due to loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods.

Retention of title
The items delivered shall remain the exclusive property of Lana Lauwers Ceramics until payment in full by the Customer.

Right of withdrawal
The provisions of this article apply only to Customers who purchase items online from Lana Lauwers Ceramics in their capacity as consumers.

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must

informed of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail).

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Lana Lauwers Ceramics, Groene Hofstraat 17, 2850 Boom, Belgium, without delay and in any event not later than 14 calendar days from the day on which he communicates his decision to withdraw to Lana Lauwers Ceramics.

The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

The Customer is requested to return the items in their original condition and packaging. If the returned item has diminished in value in any way, Lana Lauwers Ceramics reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned articles must not have been used. If an article has suffered a reduction in value due to the Customer's use, this will be charged to the Customer.

If the Customer has requested that the provision of services begin during the withdrawal period, the Customer shall pay an amount proportionate to what has already been delivered at the time he has notified us that he is withdrawing from the contract, compared to the full performance of the contract.

Once the item(s) have been returned and received in the agreed condition, you will receive a credit note via mail. This can be used both online and in the studio.

Warranty
Under the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact Lana Lauwers Ceramics and return the item at the Customer's expense.

If a defect is detected, the Customer must inform Lana Lauwers Ceramics as soon as possible. In any case, any defect must be reported by the Customer within a period of 14 days after its detection. Thereafter, any right to repair or replacement lapses.

The (commercial and/or legal) warranty shall never apply to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Privacy

The controller respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.

The website and webshop was created with shopify. Shopify manages and provides the tools with which Lana Lauwers Ceramics maintains data.

The personal data provided by you will only be used for the following purposes:

You have a legal right to inspect and correct your personal data. Subject to proof of identity (copy of identity card), you can obtain written notification of your personal data free of charge by means of a written, dated and signed request. If necessary, you can also request the correction of any data that might be incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge.

We treat your data as confidential information and will not transfer, rent or sell it to third parties.

The customer himself is responsible for keeping his login data and password confidential.

Use of cookies

Failure at any time by Lana Lauwers Ceramics to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - Disputes

Belgian law is applicable, with the exception of the provisions of international private law on applicable law.

The courts of the Consumer's domicile have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
